Individual Participant Agreement
By signing this Agreement, whether physically or electronically, the undersigned (“Participant”) and the Karate Ontario irrevocably agree as follows:
Status
As per the Bylaws of the Karate Ontario, which the Participant has read and understood, the Participant is part of the Karate Ontario but is not a Member of the Karate Ontario as Membership is reserved solely for Dojos. The Participant is entitled to all the rights, duties and privileges set forth in the Karate Ontario Bylaws for individual Participants.
Policies of Karate Ontario
The Participant shall abide by all the Bylaws and Policies of the Karate Ontario and are afforded the protections under these Policies and are likewise subject to discipline under the Policies for non-compliance. The Participant has read the Policies of the Karate Ontario and has access to these Policies through the Karate Ontario website. The Participant shall sign all required forms of the Karate Ontario that are applicable. All Participants under the age of eighteen (18) shall be required to have their parent or legal guardian sign these forms.
Waiver & Indemnification
Upon acceptance as a Participant of Karate Ontario I agree to abide by the policies and procedures of the Karate Ontario. As a Participant of Karate Ontario I shall uphold the high standards of Karate Ontario and shall never do anything to damage the reputation of Karate Ontario. I also understand and agree that any violation of this contract may result in discipline linked to the Discipline and Complaints Policy.
I understand that there are risks and dangers inherent in martial arts training and in participating in and/or receiving instruction. I understand and agree that by signing this Waiver/Release, I am assuming full responsibility for any and all risk of personal injury or death or for property damage suffered by me while participating in and/or receiving instruction in Karate. I expressly acknowledge that my participation in Karate may subject me to personal injury or bodily harm and I assume any and all risks of that participation. I also understand that I am receiving instruction from a Dojo that is not owned or controlled by the Karate Ontario and that I have no right hold the Ontario Karate Federation and its affiliates, officers, directors, agents employees and anyone connected to the Karate Ontario (collectively the “Releasees”) liable for any injury or damage which I may suffer while participating in and/or receiving instruction in Karate.
I understand and agree that this Waiver/Release will have the effect of releasing, discharging, waiving and forever relinquishing any and all actions or causes of action that I may have or have had, whether past, present or future, whether known or unknown, and whether anticipated or unanticipated by me, arising out of my participation in and/or receipt of instruction. Knowing this, and in consideration of being permitted to participate in the Karate Ontario, I hereby release and agree to indemnify and hold harmless the above-named Releasees individually and their entities, and their officers, agents, principals, partners, shareholders, directors and employees from any and all liability or costs, including attorney fees, associated with or arising from my participation in and/or receipt of instruction. I further understand and agree that this Waiver/Release will be binding on my spouse, my heirs, my personal representative, my assigns, my children, any guardian ad litem and me for said children.
I understand that if I am signing this Waiver/Release on behalf of my minor child, that I will be giving up the same rights for said minor, as I would be giving up if I signed this document on my own behalf. I acknowledge that I have read this Waiver/Release Agreement and that I understand the words and language in it.
